Private Provider Services

Florida Statute §553.791 titled “Alternative Plans Review and Inspection”, now commonly referred to as the “Private Provider Law” throughout the State, allows the Fee Owner of a building the option of using a Private Provider, such as an Architect or Engineer, to provide the mandatory building code compliance plans review and/or inspections for the structural, mechanical, electrical, and plumbing components of a building.

Enacted on October 1, 2002, the Private Provider Law is gaining popularity throughout the State from both the private and public sectors. Qualified private sector inspection and plan review firms- like CAPRI Engineering- are now able to take on the responsibility of processing compliance paperwork in a timely manner while freeing up municipal resources that can better be utilized for more important services such as hurricane rehabilitation. This change is welcome in the industry as it promotes the municipal economy, eliminates economic waste, aides overwhelmed building departments and helps developers and contractors meet their important deadlines.

Required Forms

The Statute requires notification of building departments, at the time of application, for a permit that private providers will be used and the filing of a sworn affidavit(s) by the private provider's plans reviewer(s) stating plans comply with the Code. The two attached forms were established by the Florida Building Commission for statewide uniformity.

Other forms, required by law, are subject to local discretion and must be obtained from the local authority having jurisdiction. There are a number of requirements of law concerning permit application requirements and notification/reporting to the permitting jurisdiction as well as requirements for building department response.
